In a company, especially
in a high tech one, the valuable skills of personnel of department
of research and development always bring up the issues of intellectual
property. Sometimes IP is the most valuable asset of a high tech
company. One can see that management of the intellectual property
is very important to such a company:
First, the employees of
the RD department surely should be required to keep the confidential
information of the intellectual property, and the ownership of
the IP created on the job or should be arranged in a reasonable
way. In similar circumstances, employment contracts for the IP
inventors/employees should be arranged in regard to the IP ownership
and other issues with implication the local laws.
Secondly, it is the world
trend to co-work with another company (for example ODM) or outsource
to develop inventions of high technology. In such cases, all confidential
and high technology information between co-operating companies
would need to clearly define their rights and obligations in the
agreement beforehand. In those cases, Wispro can provide the most
considerable recommendations for our clients.
Thirdly, during the progress
of R&D, there may be a need to license, assign, or transfer
IP rights to others or get licensed, assigned or transferred the
same. The legal structure of those transactions, especially involving
different jurisdictions could be complicated. A company never
wishes to pay an apple money buy an orange.
Finally, we realize that
at later stage of R&D, there comes the manufacturing. The
manufacturing involves the procurement of equipment, leasing,
and importing and exporting, tax incentive and subsidy applications,
and regulations, perhaps, the certification of standards (for
example, UL, WEEE, RoHs) We think for our clients in full scale
to plan out projects like those.
